Terms and Conditions.

The terms and conditions established in this document are applicable to the use of the website: Fr9.com. Therefore the person using this website, from now on known as "user", accepts the terms and conditions as established in this document.

Any modification or future change in the services that this website has to offer, could imply the modification of the present terms and conditions in the moment that Fr9.com's administrators believe it to be relevant or necessary. Likewise it is the responsibility of the user to keep up to date (to stay informed on any update that might take place) with the changes that could take place. In the event that the user does not agree upon the conditions of use at any time (does not agree with the present terms of use), or with any term specified or implied, the user should not use Fr9.com and has the right to move away or stay and abide by these terms.

1. Sharing Your Content and IP Licensing (Intellectual Property Licensing):

   You are the only person responsible for the content and information you post on Fr9.com, and only you can control how this information will be shared through the configuration of your profile and friends settings.

   1. In addition:

      For content that is covered by intellectual property rights, like photos and text ("IP content"), you specifically give us the following permission, subject to your privacy and application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with Fr9.com ("IP License"). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.

   2. When you delete IP content, it is deleted in a way similar to emptying the recycle bin on a computer. Be aware and understand that removed content may persist in backup copies for a reasonable amount of time (but will not be available to others).

   3. FR9.com appreciates your feedback or any other suggestion you might have to improve our community. No compensation will be paid for the use of submitted material or comments.

2. Safety:

   We do our best to keep Fr9.com safe, but we cannot guarantee this. We need your help to ensure a safe forum, which includes the following commitments:

   1. You will not send or post unauthorized commercial communications (such as spam) on private messages, chats or in any other part of FR9.com.

   2. You will not collect users' content or information, or otherwise access Fr9.com, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.

   3. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on Fr9.com (chain mail).

   4. You will not upload viruses or other malicious code.

   5. You will not solicit login information or access an account that belonging to someone else.

   6. You will not bully, intimidate, or harass any user.

   7. You will not post content that: is hateful, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

   8. You will not offer any contest, giveaway, or sweepstakes ("promotion") on Fr9.com without our prior written consent. If we consent, you take full responsibility for the promotion, and will follow our Promotions Guidelines and all applicable laws.

   9. You will not use Fr9.com to do anything unlawful, misleading, malicious, or discriminatory.

   10. You will not do anything that could disable, overburden, or impair the proper working of Fr9.com, such as a denial of service attack or any other attempt to make the network unavailable to its users.

   11. You will not facilitate or encourage any violations of this Statement.

3. Protecting Other People's Rights:

   We respect other people's rights, and expect you to do the same.

   1. You will not post content or take any action on Fr9.com that infringes or violates someone else's rights or otherwise violates the law.

   2. We can remove any content or information you post on Fr9.com, if we believe it violates this Statement or any of our statements.

   3. If you infringe other people's intellectual property rights, we will disable your account when appropriate.

   4. If you collect information from users, you must: obtain their consent, make it clear you (and not Fr9.com) are the one collecting their information, and provide a privacy policy explaining what information you collect and how you will use it.

   5. You will not post anyone's personal identification of financial information on Fr9.com.

   6. You will not tag users or send email invitations to non-users without their consent in any way.

4. Access to Fr9.com's services:

   1. Subject to your acceptance of these Terms, Fr9.com grants you a non-exclusive, non-transferable, revocable limited license to use and display the Service and related software (excluding source and object code) for your personal (or household) non-commercial use by any machine(s) of which you are the primary user. You agree not to use the Service for any other purpose, or to copy or distribute the content of the Service except as specifically allowed in this agreement.

   2. Fr9.com reserves the right to change these Terms in any way and at any time. However, no amendment to these Terms shall apply to a dispute of which Fr9.com had actual notice on the date of amendment.

   3. We will notify you about any modifications to these Terms with one method: We will post any modifications here. You agree that you will periodically check Fr9.com for updates to these Terms. You agree that you will be considered to have been given notice of any modifications once we post them to Fr9.com and that your continued use of the Service after such notice shall be deemed an acceptance of any changes.

   4. Fr9.com reserves the right to discontinue the Service or to change the content of the Service in any way and at any time, with or without notice to you, without liability.

   5. Your use of the Service is conditioned upon your compliance with these Terms and any use of the Service in violation of these Terms will be regarded as an infringement of Fr9.com's copyrights in and to the Service.

   6. Fr9.com reserves the right to terminate your access to the service without notice if you violate these Terms.

5. User Content:

The Service may invite you to chat or participate in contests, message boards, online polls and other functionality and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute or broadcast content and materials to Fr9.com and/to or via the Service, including, without limitation, text, writings, photographs, graphics, comments, suggestions or personally identifiable information or other material (collectively "User Content"). Any material you transmit to Fr9.com will be treated as non-confidential and non-proprietary.

You agree that your User Content is wholly original and you exclusively own the rights to your User Content, including the right to grant all of the rights and licenses in these Terms without Fr9.com incurring any third party obligations or liability arising out of its exercise of the rights there to granted herein by you.

You grant to Fr9.com the unrestricted, unconditional, unlimited, worldwide, irrevocable, perpetual fully-paid and royalty-free right and license to host, use, copy, distribute, reproduce, disclose, sell, resell, sublicense, display, perform, transmit, publish, broadcast, modify, make derivative works from, retitle, reformat, translate, archive, store, cache or otherwise exploit in any manner whatsoever, all or any portion of your User Content to which you have contributed, for any purpose whatsoever, in any and all formats; on or through any and all media, software, formula or medium now known or hereafter known; and with any technology or devices now known or hereafter developed and to advertise, market and promote same.

   4. Fr9.com has no obligation to monitor or enforce any intellectual property rights that may be associated with your User Content, but Fr9.com does have the right to enforce such rights through any means it sees fit, including bringing and controlling actions on your behalf.

   5. Fr9.com has no obligation to accept, display, review, monitor, or maintain any User Content. We have the right to delete User Content from the Service without notice for any reason at any time. Fr9.com may move, re-format, edit, alter, distort, remove or refuse to exploit User Content without notice to you and without liability.

6. Usage Rules:

   As a condition of your use of and access to the Service, you agree to comply with these Usage Rules, which are provided as an example rather than as a limitation, and any application or game specific rules published within the Service.

   1. You agree that your use of and your conduct on the Service shall be lawful and your User Content will not:

   12. Make improper use of Fr9's support services or submit false reports of abuse or misconduct;

   13. Engage in any commercial activities, including, without limitation, any attempt to raise money for anyone or advertise or promote a product, service, website, pyramid scheme or other multi-tiered marketing scheme;

   14. Disparage, tarnish, or otherwise harm, in Fr9.com's opinion, Fr9.com and/or the Service;

   15. Violate these Terms or any local, state, federal or international law, rule or regulation or any other requirements or restrictions posted by Fr9.com on the Service;

   16. Disseminate or transmit viruses, worms, Trojan horses, RATs, keyboard loggers, time bombs, spyware, adware, cancelbots or any other malicious or invasive code or program;

   17. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text) that interferes with any party's uninterrupted use and enjoyment of the Service and User Content or modifies, impairs, disrupts, alters or interferes with the use, features, functions, operation or maintenance of the Service, the User Content;

   18. Copy or adapt the Service's software including but not limited to Flash, PHP, HTML, JavaScript or other code;

   19. Reverse engineer, decompile, reverse assemble, modify or attempt to discover any software (source code or object code) that the Service create to generate web pages or any software or other products or processes accessible through the Service;

   20. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including, without limitation, clear graphics interchange formats ("gifs"), 1x1 pixels, web bugs, cookies or other similar devices (sometimes referred to as "spyware," "passive collection mechanisms" or "pcms");

Except as may be the result of standard search engine or Internet browser usage, use or launch, develop or distribute any automated system, including, without limitation, any spider, robot (or "bot"), cheat utility, scraper or offline reader that accesses the Service, or use or launch any unauthorized script or other software;

7. Registration and User Account Security:

   You agree to provide true, accurate, current and complete information about yourself ("Registration Data") and not give it to anyone;

8. Users that maintain more than one account on a social network may not access this Service from multiple accounts. If you provide any information that is untrue, inaccurate, not current or incomplete, or Fr9.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Fr9.com reserves the right to suspend or terminate your ability to participate in this Service and refuse any and all current or future use of this Service (or any portion thereof). Provider reserves the right to terminate accounts that have been inactive for 90 or more consecutive days.We reserve the right, but have no obligation, to monitor and/or manage disputes between you and other users of the Service. If you have a dispute with other users, you release Fr9.com and hereby agree to indemnify Fr9.com from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute.

9. Prizes:

   Fr9.com reserves the right to ban any user when the Fr9.com administration suspects unsportsmanlike behavior or any other conduct that is not tolerated within the community (see usage rules). Fr9.com reserves the right to suspend, change or terminate the prizes at any time and for any reason within a period of 30 days. It is a condition of entry that the rules are accepted as final, and that the entrants agree to abide by the rules.

   To prevent abuse by users that have been previously banned and have created a new account to participate in the prize giveaway, we reserve the right to remove these users from the competition and therefor will not be eligible to win prizes. We base our investigation on ip addresses, names, last names and any other information the user in question has provided directly or indirectly to Fr9. Consequently, this user will also be banned from the community.

   The user accepts the following:

   1. Entry into all competitions is deemed acceptance of the terms and conditions.

   2. Prizes will be couriered to the winners once winners and eligibility are confirmed.

   3. Prize claim is consent to use name of winner for publicity purposes.

10. Term Updates

    Because laws and policies covering the Internet can change quickly, we need to keep up. To do so, we reserve the right to make changes to these Terms of Use at any time, though we will post the amended Terms of Use right here when we do so.

    Your continued use of our Website following the posting of changes to the Terms of Use will mean you accept those changes.

11. Vip club

    The fr9 Chips that a user receives after signing up for vip club fr9.com will remain in the user's account (if they are not used for any game) and have no expiration date.

12. Indemnification:

    1. You agree to defend, indemnify and hold harmless the Fr9.com Parties from and against all claims and expenses, including attorneys' fees and costs, arising out of your use of the Service and/or your breach or alleged breach of any term, condition, obligation, representation or warranty in these Terms. You agree that the provisions in this paragraph will survive any termination of your account or the Service.

    2. You acknowledge that the rights granted and obligations made hereunder to Fr9.com are of a unique and irreplaceable nature, the loss of which shall irreparably harm Fr9.com and which cannot be replaced by monetary damages alone so that Fr9.com shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in the event of any breach or anticipatory breach by you. You irrevocably waive all rights to seek injunctive or other equitable relief and agree to limit your claims to claims for monetary damages (if any). In case of conflict between the English version of these terms and any other version, the Spanish version will prevail over the rest.You agree to provide true, accurate, current and complete information about yourself ("Registration Data") and not give it to anyone.
